echOchallenge2024 is a study aimed at medical interns.
Article 1 - Organization
The company echOpen Factory SAS, registered in the Paris Trade and Companies Register under number 882 017 346 and whose registered office is located at 1 place du Parvis Notre-Dame, Hôpital Hôtel-Dieu, 75004 Paris, and the association echOpen Foundation whose registered office is located at 23 rue Grenetta 75002 Paris, are organizing a study entitled "echOchallenge 2024" accessible via an online participation form, from 13-11-2024 until 27-11-2024.
Participation in this study is exclusively reserved for medical interns registered in France, and aims to select participants to contribute to the debate on the training and deployment of clinical ultrasound.
Gratuities for this study are provided by the echOpen Foundation, a non-profit association under the French law of 1901, committed to making ultrasound accessible to all, or by echOpen Factory SAS in return for the provision of a service, the results of which will enable echOpen to better understand the expectations of future healthcare professionals in terms of medical equipment.
Article 2 - Participation conditions
The study is open to medical interns residing in France and working in French healthcare establishments, excluding members of the echOpen Factory SAS team, echOpen Foundation, and their families. echOpen reserves the right to refuse participation in the study to anyone who does not meet these conditions. Participation is free and without obligation to purchase.
Article 3 - Terms of participation
Participants can take part in the study by completing an online questionnaire available at echopen.com/echochallenge-2024. Participants must complete the questionnaire and provide the information requested before the closing date indicated above.
To take part in the selection, entrants must expressly :
- agree to take part, if selected, in all the contribution sessions organized by echOpen, detailed in article 5.
Article 4 - Selection of winners
65 winners will be selected according to the level of completion of the form and the quality of the answers provided. Participants' specialties may also be taken into account to ensure that the consultation sessions are as representative as possible. An independent selection committee comprising healthcare professionals andechOpen staff will evaluate the responses and select the winners.
Depending on their ranking, winners will be required to take part in various consultation sessions withechOpen teams in order to receive the corresponding bonus.
Gratuities are therefore considered as remuneration for services rendered, the conditions of which are detailed below.
Article 5 - Gratuities
Depending on the category in which they are selected following completion of the questionnaire, participants will have the opportunity to obtain the following rewards as consideration for the fair market value of the service to be provided by the winner according to the category in which he or she has been selected:
1. Gratuity
50 ultrasound probes echOpen O1 (beta version): unit value €800
Type of consideration
To win a echOpen O1 ultrasound probe (beta version), the winner must take part in 3 half-day exchanges organized by echOpen as part of a boot camp on clinical ultrasound training.
2. Gratuity
15 one-day training courses in clinical ultrasound, organized by echOpen : unit value €640
Type of consideration
To win a one-day training course in clinical ultrasound, the winner must take part in 2 half-day exchanges organized by echOpen as part of a boot camp on clinical ultrasound training.
Details of the organization of half-day discussions and other events will be sent to the winners at echOpen . Topics to be covered during half-day discussions with echOpen may include, but are not limited to:
- feedback on the new features of the echOpen O1 probe,
- discussions on training courses in clinical ultrasound,
- thoughts on future functionalities to be integrated into the echOpen application.
Winners acknowledge and agree that prizes are awarded on a personal basis and may not benefit any person other than the selected participant.
Article 6 - Announcement of results
Winners will be notified by e-mail to the address given at registration within 15 days of selection. The results will also be published on theechOpen website www.echOpen.com. If a winner does not respond within 30 days of receipt of the notification e-mail, he/she will be deemed to have withdrawn from further participation in the study and a new winner may be selected. In any event, for regulatory reasons, the selection of winners will not be validated until at least 8 working days have elapsed after echOpen has received the winner's reply to the e-mail notifying him/her of his/her selection by echOpen.
Article 7 - Gratuity payments
The prizes will be sent or delivered to the winners as agreed by echOpen Foundation and echOpen Factory SAS. Prizes are non-exchangeable, non-refundable and cannot be exchanged for cash.
Where they are awarded in return for the winner's participation in exchange days with echOpen, the prizes may only be awarded once the winner has personally and effectively participated in all of the said exchanges. The winner will nevertheless remain fully independent ofechOpen and will in no way be considered as a representative, agent or employee ofechOpen.
The participant accepts and acknowledges that if the service required in return for a bonus is not carried out in full, the bonus will not be awarded, without compensation fromechOpen.
Article 8 - Personal data
The participant acknowledges and guarantees that the personal data communicated as part of his/her participation in the study are sincere and accurate.
The information collected on participants is intended for echOpen Factory SAS and may be reprocessed for research or commercial prospecting purposes. By taking part, candidates accept that their data may be used in this way. This information will be processed in accordance with the confidentiality policy available at the following address: Privacy policy.
In accordance with the French Data Protection Act of January 6, 1978 and the General Data Protection Regulation (RGPD), participants have the right to access, rectify and delete data concerning them. Any request to this effect may be sent to the following address: dpo@echOpen.com.
Article 9 - Liability
echOpen Factory SAS and echOpen Foundation cannot be held responsible in the event of Internet network malfunction, site unavailability or any other technical problem preventing participation in the survey.
Article 10 - Acceptance of the rules
Participation in the study implies full acceptance of these rules. Failure to comply with these rules will result in disqualification. These rules are available on request from contact@echOpen.com and can be consulted on theechOpen website.
Article 11 - Disputes
This study is subject to French law. Any dispute relating to the study must be sent in writing to echOpen Factory SAS within 15 days of the end of the study. In the event of persistent disagreement, any disputes will be submitted to the competent courts of Paris.
Article 12 - Declaration and transparency
In accordance with the regulations applicable to the supervision of benefits offered to people practising and training in the healthcare professions, the present rules, as signed by the participant by filling in the corresponding box, must be declared by echOpen to the Ordre des Médecins. echOpen undertakes to pass on to the participant any comments it may receive from the Ordre des Médecins on the content of the present rules.
In accordance with its obligations under the French Public Health Code, echOpen also undertakes to make public a certain amount of information required concerning the relationship between the participant and echOpen, as well as any gratuities received by the participant in this connection, which the participant acknowledges and accepts.
Participation in this study and, where applicable, the awarding of a prize, do not imply any obligation to supply, use, purchase, recommend, promote or prescribeechOpen products and services at any time whatsoever.
By accepting these rules, the participant agrees to be bound by their terms with respect toechOpen.
